A little known fact is that more than half of the signers of the Declaration of Independence were lawyers. Our problem these days is not that we have too many lawyers. A free society needs lawyers because this is earth, not heaven. Present-day Japan, for example, has few guns and few lawyers, but is not a very free society. Beware of those who would use force or restraint to create heaven on earth (Joe Stalin: "Let's kill all the lawyers").
The main problem we have these days is too much litigiousness--for example, too many Christians suing other Christians. This problem is perpetuated by Big Law pushing special-interest legislation and using their influence within mandatory state bars to stifle the efforts of smaller law firms (for example, trust attorney) to provide more efficient planning services, minimizing the need for such litigation.
Saying we have "too many lawyers" is like saying we have "too many guns" - you are the weapon, your lawyer is just a tool. Use your lawyer for defense only, and only to the extent necessary, not to ruin. He who lives by the law, will die by the law.
No lawsuit is filed without a plaintiff, and as for costly and tumultuous probate court, the heirs of those who plan need not pay for the errors of those who don't.

I suppose that when the going got tough, even the Founders started swearing. But how?

I may be overreacting and this sitemeter snip below may simply represent a fine FEMA official friendly to gun rights, surfing the internet in spare time between disasters, but i just find this FEMA visit to my blog post on Obama's recent banning of the M1 shipment from Korea to be CREEPY, even more so than the snips i have of CHP visiting my post on the California Highway Patrol's role in forcibly disarming NOLA residents during Katrina, and similar snips over the years. [UPDATE: Oh, I forgot to mention the somewhat predictable visits by the ubiquitous "Performance Systems International" including one to this very post, within seconds of posting. UPDATE2: followed by another to my law site, both copied below.] Stuff like this makes me think of Holodomor when I hear of irrational controls on Central Valley agriculture, milk and CO2 classified as pollutants, millions on food stamps....

Recently I posted my opinion on why the NRA was mistaken to focus on guns only, and I am pleased to observe some shift toward confronting other issues.
We are now in the early stages of Second Amendment jurisprudence; there is much work to be done; and NYT's thesis, below, that the shift is because Second Amendment issue is "settled" now and the successful NRA is just moving on to other issues because it has the money, seems to me to be just total and complete BS:

Conservatives love Ayn Rand for her great writing and the moral case she makes for individual freedom, but typically we reject her atheism. Many of us are surprised to learn she was anti-gun, or at least very equivocal on armed self-defense. Relevant Ayn Rand quotes:
“I do not know enough about it to have an opinion, except to say that it’s not of primary importance. Forbidding guns or registering them is not going to stop criminals from having them; nor is it a great threat to the private, noncriminal citizen if he has to register the fact he has a gun. It’s not an important issue, unless you’re ready to begin a private uprising right now, which isn’t very practical.” [Answer to question “What is your opinion on gun control laws?” at Lecture, “The Moratorium on Brains” (Boston, Ford Hall Forum, 1971).]
“It’s a complex, technical issue in the philosophy of law. Handguns are instruments for killing people—they are not carried for hunting animals—and you have no right to kill people. You do have the right to self-defense, however. I don’t know how the issue is to be resolved to protect you without giving you the privilege to kill people at whim.” [Answer to question “What’s your attitude toward gun control?” at Lecture, “Censorship: Local and Express” (Boston, Ford Hall Forum, 1973).]
Granted, Ayn Rand did not grow up with American gun culture (though my wife came from Soviet Ukraine and understands well the importance of guns). Also, she did not have benefit of the voluminous legal and criminological research over the last several decades demonstrating the utility of guns.
Yet in noting her surprisingly anti-gun statements it is interesting to speculate on whether her atheism may have something to do with her lack of enthusiasm for armed self-defense. Certainly many atheists lead great and good lives and make fine, upstanding, armed citizens. (I’m no theologian but I believe Ayn Rand, who died in 1982, is no longer an atheist; she’s up there somewhere and God has probably allowed her to rename it “Galt’s Gulch,” or at least “God’s Gulch.”) I just disagree that atheism works on a grand scale to encourage values we need in a free society. I believe this is why communists sought to destroy religion and family.
In talking with people about armed self-defense, it’s amazing how frequently I hear: “I’m afraid I would shoot someone.” I usually take this kind of statement to mean they are afraid of shooting an innocent person, but as I consider the Ayn Rand quotes above I wonder if in some cases there is a fundamental unwillingness out there even to shoot evil people in defense of innocent life. More often, it is probably just an increase in fear due to lack of a theological roadmap. I can talk to them about how the equities are usually pretty clear in the case of a violent criminal attack against a family member, and how firearms training can help you stay within the societal ethics prescribed by law, but people don’t usually make moral decisions of this nature based on what is “taught” by court and legislature (human institutions) – these people are perhaps really at some level concerned, justifiably, about possible deadly hesitation which may result from not having some kind of a theological guide on whether to pull that trigger. Many atheists get good firearms training and do fine with all this; just speculation here, but possibly this basic fear may dissuade the majority of atheists from getting any private training.
As Ronald Reagan said, “Evil is powerless when the good are unafraid.” (And as I said, atheists can of course be good.)
If you are going to use lethal force, in matters of life and death, your decision “damn” well better be morally correct. Not to draw too close a parallel between lethal force and the Holy Eucharist, note Paul’s warning in 1 Corinthians 11:27-29: “Therefore, whoever eats the bread or drinks the cup of the Lord in an unworthy manner will be guilty of sinning against the body and blood of the Lord. A man ought to examine himself before he eats of the bread and drinks of the cup. For anyone who eats and drinks without recognizing the body of the Lord eats and drinks judgment on himself.”
Faith is acquired through study and practice, as is firearms proficiency. It can move mountains, and it can certainly remove deadly hesitation in responding to a violent attack on your family.

A test run for the main event, perhaps to suppress opposition to global governance? Before 2005, only a "right-wing nutjob" could be worried about mass gun confiscation. Well, it actually happened and elite institutions have done a pretty good job of keeping you from finding out.

The decision shocked families of victims, who were infected or died because they were transfused with blood infected with HIV. Never in history, with the exception of the Japanese self imposed isolation in the 1600s, did a government actively force its people away from economic activity and industry. Even the Soviets never created such idiocy. The great famine of the late 1920s was caused by quite the opposite, as the Soviets collectivized farms to force peasants off of their land and into the big new factories. Anyone who has visited a socialist country can tell you socialism isn't the answer to cleaning up the environment. Same with women's rights.
There are probably many examples of gender discrimination in various degrees by socialists: female babies aborted in china; mistreatment of females by islamic socialists given a pass by american socialists; etc.
Then of course, socialists are great at training mothers-to-be to fight and die for socialism:

My wife just mentioned something relevant on this, which is why I'm posting. When she was growing up in Ukraine SSR her parents applied for a larger apartment but were denied because they had two daughters. They would have been approved if they had either three daughters, or one daughter and one son.
Something to think about as Obama's Big Fannie spreads its influence over the housing market.

First, the population was dumbed down through a politicized and substandard education system based on pop culture, rather then the classics. Americans know more about their favorite TV dramas then the drama in DC that directly affects their lives. They care more for their "right" to choke down a McDonalds burger or a BurgerKing burger than for their constitutional rights. Then they turn around and lecture us about our rights and about our "democracy". Pride blind the foolish. Then their faith in God was destroyed, until their churches, all tens of thousands of different "branches and denominations" were for the most part little more then Sunday circuses...

Despite the greatness of Hayek, he was not as great a systematic thinker as Mises. In The Constitution of Liberty, for example, Hayek claims that, so long as it is making general rules (i.e., not legislating for the particular advantage of any one group), the government can perform certain services in competition with private companies, or when no private company does the job. Most Austrian economists, Mises included, would argue that the government ought not compete in the marketplace, and that if no private entrepreneur can do something for a profit, that is precisely the reason why government ought not to do it: it is a waste of resources. Perhaps this is what Goldberg is getting at by his reference to Hayek’s "pragmatism." If so, it should be noted that Hayek does not view his own acceptance of occasional market interventions as a "pragmatic" compromise of laissez-faire principles. Instead, Hayek maintains that the government must be careful not to intervene in the wrong way and for the wrong reasons.

More and more houses in Ladera Ranch (well, at least on my street) are now flying the First Navy Jack, a flag from the Revolutionary War, popular with the current tea party movement and featured prominently by the newly influential Tenth Amendment Center.
I started flying mine a few months ago, not realizing others were having the same idea. I took mine to a tea party on April 15 and was surprised to see several others there. I then purchased quite a few to give out to my CCW students (www.7-4-1776.us), including my neighbor two doors down who is retired Navy (Annapolis grad) and flying it proudly. Another neighbor on my street has paid for a seat in the class and will be flying the flag soon. (She is Neighborhood Rep and is running to be on the board of directors for LARCS.) A fourth Navy Jack will soon be flying by a neighbor on the other side of our little street, who it turns out runs one of the main blogs on Friedrich Hayek.
Finally, I just received a call from someone that wants me to hold one of my mobile CCW classes in another part of Ladera Ranch, for ten students--that will be another ten Navy Jacks and we are just getting started.
